The transcript is excerpts from the last day of the trial - January 23, 2004.
Justice Myra Bielby assists Elizabeth MacInnis in assessing what Donald Broder knows as he fired Bryan Kickham 10 days before the commencement of the trial scheduled for January 19 - 23, 2004. Donald Broder was now self-represented at trial and the Courts could not rely on what a lawyer would or would not say during the trial.
At the start of the trial, 10:00 am on January 19, 2004 Donald Broder appeared without a lawyer. The first step Justice Myra Bielby would take to assist Elizabeth MacInnis is to ask Donald Broder if he would like an adjournment to retain new counsel.
Should Donald Broder agree for an adjournment to retain new counsel then it would become obvious to Elizabeth MacInnis that he did not know he had already won the lawsuit based on The Chief Justice A. H. Wachowich court order and didn't need counsel at all.
Donald Broder declined the adjournment and proceeded unrepresented.
So, by declining the adjournment the trial commenced and Donald Broder's Opening Statement were read. Because of what was said in Donald Broder's opening statements and immediately after lunch, Justice Myra Bielby explained she ran into case management Justice Marceau "the justice that was told by Elizabeth MacInnis she had filed the conditional certificate of readiness on April 17, 2003" and he was available if both sides agreed for him to come into the court room and attempt to negotiate a resolution with both parties. Big mistake accepting.
By accepting the offer, it made it clear to Elizabeth MacInnis that Donald Broder did not know about the Chief Justice A. H. Wachowich Order that closed the pleadings within the Alberta Court of Queen's Bench Action 9703-12949 as of March 15, 2001.
January 19, 2004 - Justice Myra Bielby received the answer she was looking for as Donald Broder agreed to having Justice Marceau come into the court room and try to negotiate a settlement, therefore exposing that Donald Broder did not now he had already won the lawsuit on March 15, 2001 by the Chief Justice A. H. Wachowich Court Order Elizabeth MacInnis had make the application for and was granted.
In 2006 in preparation to apply to The Supreme Court of Canada and the transcripts of the trial were ordered from Alberta Justice it was found that Donald Broder's opening statement had disappeared from the trial audio. Marvin Bloos of Beresh Depoe Cunningham was retained for The Application for leave to The Supreme Court of Canada. Marvin Bloos once again accepted a $15,000.00 retainer from Donald Broder and as soon as the check cleared was on the opposing counsel's side now with interest in protecting all involved from criminal prosecution by The Supreme Court of Canada.
Guy Lacourciere admits under oath that the first time the issue of lack of personal representatives was raised was in the original Statement of Defence filed in July 1997.
When he represented Donald Broder at The Alberta Court of Appeal - line 7, 8, 9, 10 and 11.
The comment was made
"by the court of appeal -- well, you ambushed Ms. MacInnis and we said no, nobody was ambushed in respect to this. That matter was raised at the beginning in the statement of defence."

Bryan Kickham and Elizabeth MacInnis should announce a new office location soon, they can share the prison cell that The Edmonton Remand Center held Donald Broder in from April 26 - May 6, 2004.

Elizabeth MacInnis committed perjury when asked as to the first time the defendant's Donald Broder has raised the issue of lack of personal representatives.
Elizabeth MacInnis conspired with Bryan Kickham to Amend Donald Broder's Statement of Defence to conceal that Donald Broder's original Statement of Defence had raised the issue of lack of personal representatives and the second Statement of Defence had plead Estoppel from the trial judge Justice Bielby.
Elizabeth MacInnis, Bryan Kickham, Marvin Bloos and Guy Lacourciere will go down in history along with The COVID 19 Pandemic as Crimes of the 21st Century willfully committed against the Innocent and most Vulnerable for their own personal satisfaction and monetary gain.
Should The Alberta Justice Minister initiate an inquiry immediately to stop these criminals from conspiring to defraud other vulnerable innocent Canadian citizens?
The Governments of Canada, Alberta Justice Department, Justices of The Court, and lawyers are the truly worthless bunch of white-collar criminals. They all can be bought.
