History that changed the world

Harvey Howlett the son of settlers that came to Canada at the turn is the 19 century. Set up homesteads west of Edmonton in the Carrot Creek area south west of Wildwood, Alberta.


Harvey Howlett would take workers and supplies in and out of logging camps operating way back in the wilderness before there were roads.


Edmund Broder would pay Harvey Howlett for a ride into his hunting cabin at Rat Creek around November 11, Remembrance Day every year and request supplies every couple of weeks be brought in and stay sometimes until December 20 returning home just before Christmas.


Edmund Broder built a two man shack back at Rat Lake and would make the all day hike  from his main camp at Rat Creek with pack boards to go back to the big muskeg to hunt the Elk jungles.


When big game animals were harvested way back in the jungles Edmund Broder would hike to saw mills in and around the area where he could hire a man and a horse for a day or two to go haul out the game.

[4] By the time the respondent discovered or recalled this, the limitation period had long passed. The respondent moved to cure the misstatement in its statement of claim almost four years after the fire. The notice of motion does not seek any change to the body of the statement of claim, merely "adding or substituting Lee St. John as a plaintiff in this action."

The Limitation of Actions Act is a statute

To substitute a party to a action relies on rules of court then filing an application and providing case law to support what's being requested. Rules of Court are regulations and cannot override Statutes.

Rocklake vs. Timberjack

[15]      The problem in the present case is not that the Rules of Court lack power to amend parties or pleadings. They have them. No modern decision on amendment suggests that there is any difficulty curing parties before the limitation period expires. The problem is that there was an independent statute, the Limitations of Actions Act, which restricted times to sue.

[18]     The analytical approach adopted in Alberta is simple. One cannot sue after the limitation period. Adding a new plaintiff or a new defendant or a new cause of action to a suit after the period expires, in effect creates a new suit, so far as that the new party or cause of action is concerned. Limitation legislation is intended to give repose after a certain length of time and adding a new plaintiff or new cause of action violates that policy almost as much as adding a new defendant.

[19]     The Rules of Court do not speak about limitation periods or times to amend. They have always been reconciled with limitation legislation by presuming that the powers under the Rules are to be exercised subject to the time limits under the legislation, when those are relevant.

Legislation

When accusation of wrong doing are brought against The Crown it is legislated that the Crown be notified of the allegations in writing allow six months for The Crown to investigate itself and if the allegations are validated and deemed to be true, then The Crown is to plead guilty to itself and make restitution to the victim or victims.

Broder vs. Broder

Is now precedence and as such can be referenced in any court proceeding;

1) Court Orders do not have to be followed until such time as The Chief Justice A. H. Wachowich Order within action 9703-12949 has been followed.

2) Backdating the FIAT on The Amended Statement of Defence and forging Judges signatures is acceptable practice within the Canadian Justice Systems until such time as Bryan Kickham of Miller Thompson is criminally charged for his role in committing this crime against Donald Broder.

3) Perjury is acceptable as per Elizabeth MacInnis / Moore telling the trial Judge Justice Bielby that the first time lack of personal representative was raised by Donald Broder was early 2001, when as the facts that were presented was actually raised within the Original Statement of Defence file and served in July 1997.

4) Affidavits of Service sworn by Elizabeth MacInnis / Moore legal secretary Joan C. Hill can be based on a note to file and does not require an form of physical service to a Defendant / Beneficiary for a new action being commenced.

5) Garnishing a 75 year old lady's, Joyce M. Broder's bank account while she's in Good Samaritans Long Term Care facility dying from illness and in stage 4 Alzheimer's is a low as it goes for these white collar criminals.

6) Donald Broder's opening statement were deleted from the trial audio.

7) Chief Justice A. H. Wachowich Court Order went missing from the file at Edmonton Law Courts?

On Friday April 23, 2004, Elizabeth MacInnis / Moore requested Justice Myra Bielby cite  Donald Broder in contempt of court for not following her 2004 court order and incarcerated him until he learns a lesson to follow court orders . Justice Myra Bielby had access to the file at the trial and ought to have known that it was Elizabeth MacInnis / Moore that did not adhere to the February 13, 2001 Chief Justice A. H. Wachowich court order to file The Certificate of Readiness and close the pleading within Alberta Court of Queen's Bench action 9703-12949 on March 15, 2001 well before May 24, 2001 Surrogate Court .  Instead Justice Myra Bielby falsely incarcerated an innocent man from April 23 - May 4, 2004 for not following her 2004 court order to turn over the Broder Buck.
